So often, real estate agents are incompetent. And that’s because passing the real estate agent’s exam is not much more difficult than passing the DMV exam. Agents are often motivated by closing deals in a rushed manner rather than spending the time to educate you.
So, instead of acting like professionals, they shove a bunch of papers in your face to sign without explaining them to you. But all the papers look the same. You don’t know what’s important or what to look out for. Instead, you trust your agent. But more often than not, agents are more like car salespeople––focused on the commission. They are supposed to take the time to explain the documents you are signing. They are supposed to give you advice that you can rely on and trust. And they are supposed to investigate important things that matter to you.
But the reality is that you just sign, sign, sign, and initial, initial, initial. You have no idea what is going on. And that’s not surprising. We have highly educated clients in Silicon Valley who work at the most prestigious tech companies, yet they don’t understand the real estate world––a world of jargon that only lawyers understand. They are given a massive amount of information that nobody reads. And if they try to read it, they don’t really understand the legalities like we do.

You want to back out and get your deposit back, but you think it’s too late or impossible because you waived all contingencies. But you’re wrong. It’s almost always possible to get your deposit back, either from the seller, from your incompetent agent, or from both.
Or maybe you’ve already closed escrow and you realize you bought a lemon or a money pit. All of this happened because the seller didn’t disclose something or your agent didn’t do their job to protect you.
